A. 1. TERMS AND CONDITIONS FOR EMPLOYER-SPONSORED AND SELF FUNDED 10-WEEK BESPOKE COURSE
TERMINOLOGY: In this document, the term “CLIENT” refers to a company or employer that enrols its employees, partners, and/or executives, collectively referred to as “STUDENT(S),” in Spanish in The City’s language learning programs for employer-sponsored courses. The term “STUDENT(S)” also refers to individuals enrolled in or registered with Spanish in The City for self-funded courses.
- Spanish in The City offers Spanish language lessons for lawyers, attorneys, law students, paralegals, and business professionals. These lessons are intended solely for Spanish language teaching purposes and should not be construed as providing legal, financial, or professional advice in any way. Furthermore, these lessons are not intended to function as lectures on law or business matters, nor are they intended to serve as translation lessons. The resources provided are educational in nature, designed specifically for teaching Spanish to lawyers and businesspeople. They emphasize vocabulary and grammatical structures commonly used in legal and business settings. These materials are not intended to serve as actual legislative documents or contracts.
- Spanish in The City does not make any promises or guarantees, whether explicit or implied, about the condition, accuracy, results, quality, performance, or suitability of the services we offer. Any such promises, guarantees, or assurances are not part of the agreement and are not legally binding.
- The liability of Spanish in The City shall be subject to the following limitations: a. Spanish in The City shall not be held liable for any indirect or consequential loss or damage whatsoever, including but not limited to loss of profits, business, contracts, revenue, damage to the CLIENT and/or STUDENTS’ reputation or goodwill, loss of business opportunities, loss of anticipated savings, lack of results, loss or corruption of data, information or software, or any other similar losses. b. In relation to our services or any potential absence of them for any given reason, the maximum liability of Spanish in The City will be confined to the total fee paid to Spanish in The City for the said services.
- Prior to the start of the course or, at the latest, between the first and second lessons of the initial 10-lesson term, Spanish in The City will send the STUDENT(S) a Week-by-Week plan. This document will outline the topics, language functions, and grammar that will be covered during the term. The STUDENT(S) will have the opportunity to suggest any changes that better suit their needs.
- All learning materials to be used during the course, such as PDF documents, audio tracks, quizzes, etc., will be provided by Spanish in The City and are included in the course fee.
- While Spanish in The City strives to ensure all provided materials are free from viruses, we cannot offer a guarantee. It is the responsibility of the CLIENT and the STUDENT(S) to monitor these materials using their own internal systems. Spanish in The City will not be held accountable for any data loss, intrusion, scam, cyberattacks, or other harm caused by third party attacks.
- The invoice will be issued following the completion of the first lesson. Payment is due within 30 days upon receipt of the invoice. There is no VAT charge on Spanish in The City’s invoices.
- If the CLIENT or the STUDENT(S) wish to rearrange or cancel any lesson within the 10-lesson term, they must provide more than 48 hours’ notice before the scheduled lesson. For Monday classes, notice of cancellation must be given by Thursday of the previous week. Failure to provide timely notice will result in the lesson being charged as if it were taken.
- The 10 sessions of tuition booked must be completed within a period of three months from the date of the first lesson, unless a written notification has been given by Spanish in The City to the CLIENT or the STUDENT(S) stating otherwise.
- The learning materials provided are intended just for the personal study of Spanish in The City’ STUDENTS and are not authorized for sharing or disclosure.
- Since Spanish in The City does not provide lectures but rather Spanish language lessons, STUDENT(S) are expected to actively participate during the sessions. Lessons are student-centered, and active speaking, asking, and answering questions are encouraged.
- STUDENTS should undergo an assessment by Spanish in The City before the course begins to determine their suitability and to better prepare the Week-by-Week plan. If STUDENTS believe they do not require assessment due to their self-assessed level, the Week-by-Week plan may not fully align with their actual needs regarding topics and language use (grammar).
- Spanish in The City will utilize an open Google document for every course as a whiteboard for interactive lessons. To fully participate, STUDENTS are advised to allow access to the Google document from the computer they will be using during the sessions. Spanish in The City does not assume responsibility for any data collected by Google, nor do we hold liability for any potential damage caused by viruses or other issues related to Google.
- Given that the Google document is accessible to all, we strongly advise students against sharing any personal or identifiable information within it. Spanish in The City will not be held responsible for any data disclosed on the Google document. The open Google document is intended solely for instructional use, focusing on teaching, and practicing grammar and vocabulary.
- Spanish in The City will leverage Google Drive to provide access to listening tracks, grammar sheets, and additional resources. These materials can be easily accessed through the provided links. Spanish in The City does not take responsibility for any data collection practices implemented by Google. Furthermore, we cannot be held liable for any potential damages, including those caused by viruses or any other issues associated with the use of Google services.
- Vocabulary learning will be enhanced using the Quizlet app. For an optimal learning experience, STUDENTS are encouraged to create their own FREE accounts on Quizlet.com. Spanish in The City does not assume responsibility for any data collected by Quizlet.com, and we disclaim any liability for potential damage caused by viruses or other issues related to Quizlet.com.
- STUDENTS are strongly advised to use a desktop or laptop computer for online lessons with Spanish in The City, as they are better suited for tasks involving writing and reading. Tablets and phones, on the other hand, may be used for interactive vocabulary games.
- Unless otherwise requested by the CLIENT or the STUDENT(S), Zoom will be used as the communication platform during the sessions, which will be hosted by Spanish in The City. Spanish in The City does not assume responsibility for any data collected by the communication platform utilized, and we disclaim any liability for potential damage caused by viruses or other issues related to it.
- Spanish in The City will not conduct any recordings of sessions, and the CLIENT and STUDENTS are strictly prohibited from recording lessons in any form. If this condition is breached and any recording occurs, Spanish in The City will not be held accountable for any resultant loss or violation of data protection. It is the CLIENT’s responsibility to ensure STUDENT’S compliance with this clause.
- In the case of Employer-sponsored courses, Spanish in The City may have to disclose some STUDENTS’ personal information to the CLIENT, such as attendance, assessments results and progress reports.
- Spanish in The City does not issue any form of official accreditation or certification upon course completion. Our courses are designed for personal and professional development, and while they can significantly enhance language skills, they are not recognized as formal qualifications by educational or professional institutions. However, for candidates who attend at least 7 out of 10 lessons, we are pleased to provide a non-official certificate of attendance as a testament to their commitment and progress.
- Spanish in The City is under the jurisdiction of the laws of the United Kingdom, and in case of any disputes that may arise from the delivery of services or interpretation of these Terms and Conditions, they will be resolved according to the laws of the United Kingdom. The courts of the United Kingdom will have exclusive jurisdiction to settle any disputes that may arise out of or in connection with these Terms and Conditions.
