Description
Abuso del derecho is a nine page C1 Legal Spanish lesson designed for advanced learners who want to develop their Spanish through the legal concept of the abuse of rights.
The lesson begins with a reading examining how the principle operates in Argentina and Spain, introducing essential Legal Spanish such as derecho subjetivo, buena fe, fines del ordenamiento jurÃdico, indemnización, reposición, daño a tercero, posición dominante and ejercicio abusivo del derecho.
Vocabulary is supported by a dedicated Quizlet study set, followed by a contextual exercise requiring students to use the terminology accurately.
A substantial grammar section focuses on perÃfrasis verbales in formal and legal Spanish, including tener que, haber de, soler, llegar a, andar + gerundio, terminar por, tener + participio, venir + gerundio, llevar + gerundio and quedar + participio. Each structure is presented with its meaning and a professional legal example.
Students then complete two grammar activities. The first develops recognition of the appropriate perÃfrasis according to context, while the second requires students to select and conjugate the appropriate structure in different tenses.
The final part of the lesson moves from controlled language practice to legal discussion and argumentation. Students analyse five hypothetical cases involving property rights, employment sanctions, administrative appeals, dominant market position and an international public procurement procedure. They must decide whether the conduct represents a regular exercise of a right or potentially an abuse, supporting their arguments with concepts such as good faith, proportionality, damage to third parties and the purpose of the right.
The final case introduces an international tender, requiring students to discuss repeated challenges to a procurement procedure and distinguish between legitimate scrutiny of legality and conduct intended to obstruct the process.
Complete answers are provided for the vocabulary and grammar activities.
